TERMS OF SERVICE


Services and Supported Products

DESERT COMPUTER AGENTS provides service on the following products: Laptop Computers, Desktop Computers, Netbooks, Apple, iDevices, (iPads, iTouches, iPhones), and Data Recovery on Storage Devices. Any product not listed may be serviced at the discretion of Desert Computer Agents, but the ability to service is not guaranteed, either implicitly or explicitly. Desert Computer Agents delivers billable service hours and due to the unpredictable nature of Technology are unable to sell final products. Our Agents do the best they can to work towards the intent of our customers’ goals and for the foregoing reasons are unable to guarantee all tasks will be completed within a specific timeframe. We do our very best to keep in strong communication with the customer to assist in foreseeing the required service charge to complete the customer's task at hand, however, the customer is responsible for tracking the Agent’s time and halting service once the billable hours meet their discretion.

Estimates and Phone Estimates

We can provide an estimated cost for standard products and services. Estimates can usually be given on-site or over the phone. Estimates are not binding and shall be used for informational purposes only. Estimates may change during the course of servicing the device and any changes in scope must be approved by the customer prior to DESERT COMPUTER AGENTS performing that service. The initial estimate will remain valid for the intended service, however, DESERT COMPUTER AGENTS may recommend a different service once the analysis is performed. Final charges will be determined after the service has been completed.

Scheduling, rescheduling and handling of appointments

Desert Computer Agents strives to provide the best streamline scheduling experience to our customers. The minimum fee for all services calls is at one non-refundable billable hour for the applicable service. We understand that unforeseen circumstances may arise, so we offer one complimentary rescheduling per invoice so long as notification is given 24 hours before the time of the appointment. In the event of a cancellation within the 24-hour window, a secondary payment may be necessary before a new reservation can be made. It's important to note that appointments in progress, voluntarily closed by the customer, will be considered completed, and any pending requests will be waived, unless otherwise specified in a writing signed by an Authroized Agent.

Discounts applied at time of Payment Receipt.

All discounted transactions are applied at time of receipt of payment. Outstanding discounts not applied at the time payment is due is rendered null and void.

Warranty Exclusion

All service performed by DESERT COMPUTER AGENTS technicians in a DESERT COMPUTER AGENTS facility (except those listed in the warranty exclusions section, below), using parts purchased by DESERT COMPUTER AGENTS, to fix a specific symptom or device issue is guaranteed for 14 days from the date of the service. If multiple issues or symptoms are addressed by a repair, all are covered by the 14 day guarantee period. The guarantee does not cover issues that may develop within the guarantee period that are not related to services performed or to the original issue or symptom diagnosed and repaired.

All parts obtained by DESERT COMPUTER AGENTS for service on your device are guaranteed for 14 days from the time of installation, and are covered under warranty. Parts purchased for a repair cannot be refunded, upgraded, or returned for credit. Parts are not guaranteed to be new unless explicitly stated. While we prefer using new parts as often as possible, often only used or refurbished parts are available.

Warranty Exclusions

We do not offer warranties or guarantees, explicit or implicit, on any of the following:

  • Any service using parts not purchased through DESERT COMPUTER AGENTS
  • Any software issues, including virus removal
  • New symptoms/issues not directly tied to the original service within the 14 day guarantee period
  • Any service/new symptoms/issues outside our 14 day grace period
  • Any service modified by 3rd parties or Shadow I.T. personnel
  • Installing new hardware or modifying existing hardware in the 14 day guarantee period voids the DESERT COMPUTER AGENTS Limited Shop Warranty
  • Recurrence of original symptoms or issues caused by user error or negligence in the 14 day guarantee period, including but not limited to: physical damage (drops, crushing, exposure to temperature extremes), liquid damage (spills on and liquid immersion of the device), electrical damage (improper grounding, contact with poorly performing or damaged electrical networks), and damage caused through installation or use of harmful software components (viruses, malware, spyware), voids any warranty by Desert Computer Agents

NOTE: If your device is physically tampered with or damaged within the warranty period, the DESERT COMPUTER AGENTS Limited Warranty is void. This includes but is not limited to cracked screens, dents to the casing, internal damage not present at time of original repair, attempts to open or modify the device, or any other action, accidental or intentional, that could cause our repair to fail.

Replacement Parts Procedure

If a service requires parts to complete, we will contact and inform you of the need prior to ordering any parts. We will explain the part needed, why it’s necessary, any associated costs, and give an estimate of when the part will likely arrive. Due to shipping times being beyond our control, our estimate is a best guess and is not intended to guarantee arrival by a specific time.
If you would like to hold on to your device until parts come in, a non-refundable deposit of 50% of the cost of the ordered parts will be required.

DESERT COMPUTER AGENTS will generally not use parts not purchased by DESERT COMPUTER AGENTS. This is due to our inabillity to verify that the parts are functional and will provide a good fit for your device.

Any replacement parts not supplied by DESERT COMPUTER AGENTS are not covered by any kind of warranty or guarantee except as might be provided by the part manufacturer. By providing your own parts, you acknowledge that you understand and agree that any work we provide is not covered by the DESERT COMPUTER AGENTS Limited Shop Warranty or any other guarantee or assurance, explicit or implicit. You also agree to waive any liability for damage to your device caused by faulty parts or other part incompatibilities.

Manufacturer Warranty Repair

Some services performed by DESERT COMPUTER AGENTS may void your manufacturers warranty. Where we can, we will try to inform you before proceeding. Some manufacturers provide exemptions for professional repair shops, though we cannot guarantee in any way that yours will, nor do we have a list of manufacturers who do provide such exceptions. Always check with your manufacturer before bringing a device still under warranty in for repair work.

Any repairs or modifications to iPhones and other iDevices WILL void your warranty. By accepting service from DESERT COMPUTER AGENTS, you understand and agree that we are not held liable for voiding your devices manufacturers warranty.

Estimate and Repair Time

Estimates and repairs will be handled on a first-come, first-served basis. Due to the complex nature of Technology, Desert Computer Agents makes no guarantees either explicit or implicit that the estimate provided will be an exact estimate to match the intent of the customer.

Equipment Storage and Handling

Due to storage concerns, we will hold on to devices for up to 14 days after we contact you to pick up your device. After that time, if we have not heard from you we will consider your device abandoned and it will become property of DESERT COMPUTER AGENTS. We cannot guarantee that your equipment will not be discarded after the initial 14 day period, so it is critical that you pick up your equipment on time or make arrangements with DESERT COMPUTER AGENTS to store your equipment until you can pick it up.

Payment

Desert Computer Agents accepts all major credit cards, cash, check, Paypal and Zelle. We do not require upfront payment for estimates and diagnosis.

However, for purchase requests for hardware or software over the value of $100, payment is due upfront. Payment is due at the time that the service is rendered.

The time of appointment completion/closure is determined by the assigned Agent. "Tacking" service hours onto any appointments must be agreed upon in writing by an authorized Agent.Billing is charged in 10 minute increments over each hour during the appointment.

All residential on-site visits have a one hour minimum charge.

Data

DESERT COMPUTER AGENTS does not guarantee the security or safety of client data. While Desert Computer Agents exercises their expert judgment to ensure the integrity of client data, no liability is assumed for any lost or damaged data as a result of services performed.

DESERT COMPUTER AGENTS will bill time required for failed data recovery attempts including any that arrise with the following exceptions:

  • Any form of software issue being caused from the combination of the Data Hardware and its selected transfer medium due to abnormal Data Hardware behavior or corrupt data.
  • If a mechanical recovery is needed, we will ask for a non-refundable deposit before ordering parts necessary to complete your recovery.
  • If a competing shop has attempted recovery prior to the device arriving at DESERT COMPUTER AGENTS, we may charge a non-refundable deposit to cover the extra difficulty involved in attempting to fix any issues prior recovery attempts have caused.

FORCE MAJEURE

Desert Computer Agents shall not be liable for failure to perform any of its obligations under this Agreement during any period in which such performance is delayed by accidents beyond Desert Computer Agents’ reasonable control, such as, but not limited to fire, flood, pandemics, or other natural disasters, or, embargo, court order, riot, or other intervention of any government authority. If Desert Computer Agents’ performance is delayed for these reasons, Client may terminate this Agreement by giving Desert Computer Agents written notice.

Privacy Policy

DESERT COMPUTER AGENTS or the term “us”, “we”, or “our” refers to the owner of this website (Https://DesertComputerAgents.com). The term “you” refers to the user or viewer of this website.  This page describes our policies about the use, collection, and disclosure of personally identifiable information.

While using our website, the website automatically collects your IP Address/location, other information from your internet browser as it provides, and information that is entered by the user into forms or fields on our website. Except as otherwise specified, we will only use your personally identifiable information for providing and improving the website and providing service within our stores or over the phone. By using our website, you agree to the collection and use of information in accordance with this policy.

Information Collection and Use

While using our website or visiting any of our stores, we may ask you to provide us with certain personally identifiable information that can be used to contact or identify you regarding questions, comments, services requested, product offers, service updates, send confirmations, invoices, updates, and support and administrative messages. Personally identifiable information refers to information that is connected to your name and may include things such as your e-mail address, mailing address, or telephone number.

Log Data

We may collect information that your browser sends us when you visit our website (“Log Data”). This Log Data can include information including but not limited to: your computer’s internet protocol address, browser type, browser version, and screen resolution, the pages of our website that you visit, the order in which you visited them, and any interactions you had with our website while visiting. We may also collect time and date stamps of your visit and other data regarding your usage of our site. We also collect information relating to any search queries you used to find our site, the location of the page that you came from, and any location information that you provide us. This data is primarily used to allow us to better our marketing and services in the future, but is not necessarily limited to that usage.

Cookies

“Cookies” is a term to describe information, which may include an anonymous unique identifier that the DESERT COMPUTER AGENTS website places on the hard drive of your computer. Cookies remember information about your behavior on the website. Most internet browsers will allow you to refuse all cookies or to indicate when a cookie is being sent. However, if you do not accept cookies, you may not be able to view some pages or aspects of our website. DESERT COMPUTER AGENTS participates in behavior-based advertising.  This means that a third party may use technology (e.g., a cookie) to collect information about your use of our website so that they can provide advertising about products and services tailored to your interest.  That advertising may appear either on our website, or on other websites.

Personal Satisfaction Clause

Sharing

DESERT COMPUTER AGENTS may share your personally identifiable information with companies that are affiliated (that is, that control, are controlled by, or are under common control with DESERT COMPUTER AGENTS.

There may be instances when DESERT COMPUTER AGENTS may disclose personally identifiable information without providing you with a choice in order to protect the legal rights of DESERT COMPUTER AGENTS, other affiliated companies or their employees, agents, and contractors; to protect the safety and security of visitors; to protect against fraud or for risk management purposes; or to comply with the law or legal process.  In addition, if DESERT COMPUTER AGENTS sells all or part of its business or makes a sale or transfer of assets or is otherwise involved in a merger or business transfer, DESERT COMPUTER AGENTS may transfer your personally identifiable information to a third party as part of that transaction.

Security

No method of transmission over the Internet, or method of electronic storage, is 100% secure. While we will do our best as is reasonably possible to protect your Personal Information, we cannot absolutely guarantee its security.

Changes to This Privacy Policy

DESERT COMPUTER AGENTS reserves the right to make changes to this policy at any time. The last modified date of this policy is provided in the last paragraph of this policy. We will modify this date if we change this policy.
